Terms of Service

These Terms of Service ("Terms") govern your use of the Electryion platform and any related services (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
Electryion provides a cloud-based AI workforce platform. The Service includes a set of specialized AI employees (currently Axel, Sebastian, Talon, Carmen, PRISM, and CIPHER) that help you automate repetitive business tasks such as email management, recruiting, social media, lead generation, requirements engineering with Jira/Linear integration, and tender monitoring. We add, improve or deprecate AI employees from time to time.
2. Accounts
- You must be at least 18 years old and legally able to enter into a contract.
- You are responsible for the accuracy of your account information and for all activity under your account.
- You must keep your password secure and notify us immediately at [email protected] if you suspect unauthorized access.
- One workspace may have multiple seats. You are responsible for the conduct of everyone you invite to your workspace.
3. Free Trial and Subscriptions
Every new account starts with a 7-day free trial with no credit card required. To continue using the Service after the trial, you must select a paid plan and provide a payment method through Stripe Checkout. Paid plans are billed monthly or yearly, in advance, and renew automatically until you cancel.
If you do not start a subscription before your trial ends, access pauses until a plan is selected. You are never charged without adding a payment method yourself.
4. Billing, Refunds and Cancellation
- Subscriptions renew automatically at the end of each billing period.
- You can cancel at any time from your billing portal. Cancellation takes effect at the end of the current period and you retain access until then.
- Unless required by Dutch consumer law, payments are non-refundable. We may, at our discretion, offer pro-rated credit for downtime or duplicate charges.
- Seat additions are pro-rated; seat removals take effect at the next renewal.
5. Acceptable Use
You agree not to use the Service to:
- Violate applicable law, third-party rights, or our Privacy Policy.
- Send spam, phishing, deceptive or harassing communications.
- Upload malware, scan for vulnerabilities without authorization, or attempt to breach workspace isolation.
- Reverse-engineer, scrape, resell, or white-label the Service without written permission.
- Train competing AI models on the outputs of our AI employees.
- Circumvent billing, rate limits, or security controls.
We may suspend or terminate accounts that violate this section without prior notice.
6. AI Output Disclaimer
Our AI employees generate text, drafts and suggestions using third-party large language models. AI output can contain errors, omissions, outdated information, or content that requires human review. In particular:
- PRISM rewrites tickets in EARS (Easy Approach to Requirements Syntax) and proposes test cases. The output is a starting point, not a verified specification. You are responsible for confirming each rewritten requirement reflects the intent of your team before approving and pushing it back to Jira or Linear.
- CIPHER identifies potentially relevant tenders, but eligibility and submission decisions are your responsibility.
- Sebastian and Carmen produce outreach drafts that should be reviewed before sending to ensure accuracy, tone and compliance with anti-spam rules.
- Talon produces social drafts; you are responsible for the content you publish.
- Axel drafts email replies and surfaces commitments through optional features like Promise Radar; final send control stays with you, and Axel never sends mail without your explicit click on Send.
You are solely responsible for reviewing, editing, and approving any AI output before using it externally. We are not liable for decisions you make based on AI output.
7. Your Content
You retain all rights to the content you upload or feed into the Service ("Your Content"). You grant Electryion a limited, non-exclusive license to process Your Content only for the purpose of providing the Service to you. We do not claim ownership of Your Content and we do not use it to train AI models.
8. Connected Services
The Service integrates with third-party providers such as Microsoft, LinkedIn, Meta, X (formerly Twitter), Atlassian (Jira), Linear and Stripe. Your use of those services is governed by their own terms. We are not responsible for outages or changes made by third-party providers.
9. Intellectual Property
The Service, including its software, design, branding, AI employee personalities and workflows, is owned by Electryion and protected by intellectual-property law. We grant you a limited, non-transferable, non-exclusive license to use the Service while your subscription is active.
10. Confidentiality
We treat Your Content as confidential and protect it with the safeguards described in our Privacy Policy. You agree to treat non-public aspects of the Service (such as unreleased features and pricing you see under NDA) as confidential.
11. Service Availability
We aim for high availability but do not guarantee uninterrupted access. Scheduled maintenance, third-party outages (Stripe, Microsoft, OpenAI, OpenRouter, Atlassian, Linear, hosting), or force-majeure events may temporarily affect the Service. We will communicate material outages via email or in-app notices.
12. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. Your use of the Service is at your own risk.
13. Limitation of Liability
To the maximum extent permitted by law, Electryion is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.
14. Indemnification
You agree to indemnify and hold Electryion harmless from claims arising out of (a) Your Content, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) your misuse of AI output.
15. Termination
You may terminate your account at any time from your profile. We may suspend or terminate accounts that breach these Terms, that become a security or reputational risk, or that remain inactive for an extended period. Upon termination we delete Your Content in line with our Privacy Policy, except where retention is required by law.
16. Changes to the Terms
We may update these Terms. Material changes will be announced in the app or by email at least 14 days before they take effect. Continued use after that date means you accept the updated Terms.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. Any dispute that cannot be resolved amicably will be submitted to the competent court in the Netherlands, unless mandatory consumer law grants you another forum.
